A Boston car accident lawyer starts with your policy.

A car crash can change everything in a few seconds, leaving you with painful injuries, mounting medical bills, a wrecked vehicle, and time away from work. Most crashes are not really accidents at all; they happen because a driver was speeding, distracted, following too closely, running a light, or driving impaired. Here your own insurer covers the first medical bills whoever was at fault, but that coverage runs out quickly, and when another driver’s carelessness caused the crash you can pursue them for everything beyond it.

Insurance companies, even your own, are businesses focused on paying as little as possible. After a crash they often move fast, asking for a recorded statement, pressing for a quick, low settlement, or hinting that you were partly to blame, all before you know the full extent of your injuries. A car accident lawyer levels the field, handling the insurers, proving how the crash happened, and pursuing the full value of the claim. Larson Law represents injured drivers, passengers, and pedestrians throughout Boston and Suffolk County at no upfront cost, and you pay nothing unless we win.

Massachusetts crash claims run on rules that catch most people off guard, and the insurer knows them far better than you do. What you say in the first days, which doctor you see, and how the paperwork is filed can quietly shape what the claim is worth months later. We explain where your case stands in plain language, handle the parts that trip people up, and make sure nothing is missed while you recover.

A serious crash also brings costs that reach well beyond the first repair estimate, from ongoing treatment and lost earning power to the lasting effects of an injury. A lawyer handles the claim and the paperwork so you can focus on recovery, and because we work on a contingency fee, getting answers costs you nothing up front.

Crashes in the city take many forms, and most are caused by another driver’s choices. We help people hurt in rear-end collisions from tailgating, intersection and left-turn crashes, head-on and sideswipe wrecks, and pileups on the highways, as well as those struck by distracted, drowsy, speeding, or impaired drivers and by drivers who ran from the scene. We also represent passengers, pedestrians, and people hit by rideshare and delivery vehicles. Some clients recover in a few weeks; others face surgery, long rehabilitation, or an injury that never fully heals. Whatever the cause and however serious the harm, if another driver’s negligence led to your crash, you have the right to seek compensation, and the only way to know what your case may support is to have it reviewed by a lawyer who handles crash claims every day.

Evidence and deadlines both punish waiting. Policies can be identified, witnesses located, and the scene and records documented while the information still exists. Those early steps rarely feel urgent in the moment, but they are often what a strong claim later depends on. Daniel J. Larson personally reviews how the crash happened, who was at fault, and what your coverage allows before any claim moves forward. There is no cost to speak with the firm.

How Massachusetts Crash Claims Work.

Proving who was at fault

A car crash claim starts by showing that another driver was negligent and that their carelessness caused the crash and your injuries. That can mean speeding, distraction, failing to yield, following too closely, or driving under the influence. The proof comes from the crash itself, the vehicle damage, the police report, any traffic or dash camera footage, and witness accounts. The clearer that proof, the harder it is for an insurer to deny responsibility or shift the blame onto you.

No-fault, PIP, and your right to recover

Massachusetts is a no-fault state, so your own Personal Injury Protection coverage pays initial medical expenses and a portion of lost wages no matter who was at fault. To pursue the at-fault driver for pain and suffering, the case generally must cross a medical threshold, such as reaching a set amount of medical costs or involving a serious injury like a fracture. Your own uninsured and underinsured motorist coverage can also be vital when the other driver fled or had too little insurance to cover the harm.

Shared fault and the deadline to file

Massachusetts uses comparative negligence, so an injured person can recover as long as they were not more than half at fault, with the award reduced by their share. Most crash claims must be filed within three years, and when the injured person is a child the clock does not start until adulthood. If a crash proved fatal, the family may bring a wrongful death claim, which runs on its own deadline.

Insurers run a familiar playbook on crash files, and it is easier to answer when you expect it. Fault gets disputed, injuries get called minor or pre-existing, payments slow, and an offer arrives early enough to look generous before anyone knows what the injury actually is. We answer that with the record rather than with argument: the reconstruction, the vehicle damage, the treating doctors, the witnesses. We also take on the fight with your own insurer over what it owes first, which is the part that catches people out in a state where your own policy pays before fault is settled. Preparing every file as though a Suffolk County jury will see it is what gives a demand weight. You pay nothing up front and owe a fee only if we recover for you.

The strength of a crash claim often comes down to how completely the injuries and their effects are documented. A serious crash can cause harm that is not obvious at first, from a concussion or soft-tissue injury to a herniated disc or a fracture that only shows up days later. We make sure the medical record captures the full picture, including the future care a lasting injury may require, and where the case calls for it we bring in treating physicians and other experts to explain the prognosis and put a reliable value on what the years ahead will cost.

What the claim is finally worth is decided long before anyone discusses settlement. It turns on whether the file shows the treatment that followed, the work missed, the earning power that never came back, and the ordinary things the injury made harder. None of that gets argued into existence at the end. It is either in the record or it is not.

No two crashes are the same, and the right approach depends on the facts, the injuries, and the coverage involved. A short, no-cost conversation is the simplest way to learn how these rules apply to your situation and what your claim may be worth, with no pressure either way.

We represent injured drivers well beyond downtown, including in Cambridge, Quincy and Brockton.

Where Boston Car Accidents Happen.

Where crashes happen in Boston

Boston’s roads are notoriously challenging, and crashes concentrate on Interstate 93, Storrow Drive and Soldiers Field Road, the Massachusetts Turnpike, and the rotaries and merges that catch drivers off guard, as well as at busy downtown intersections and on neighborhood streets. Heavy traffic, sudden stops, aggressive driving, and distraction all take a toll. Wherever your crash happened, the questions are the same: who was at fault, how serious are your injuries, and what coverage is available to make you whole.

Care and where these claims are handled

People hurt in Boston crashes are often treated at Massachusetts General Hospital, Boston Medical Center, Tufts Medical Center, and Brigham and Women’s Hospital. Injury cases tied to Boston are generally handled in the Suffolk County courts, including the Boston Municipal Court and Suffolk Superior Court. A lawyer who knows the local roads, the way these crashes happen, and how the courts handle them can move quickly to gather the evidence and aim the claim in the right direction from the start.

Why fast action protects your claim

The proof in a crash case fades fast. Vehicles get repaired, skid marks wash away, traffic and business cameras record over their footage within days, and witnesses become hard to find. Acting early lets a lawyer preserve that evidence, document the injuries properly, and reach the insurers before they settle on a version of events that is hard to move later. Larson Law does that work while you focus on recovering, and never charges anything up front for it.

The first conversation is deliberately easy. Call or send a message and a Boston car accident lawyer will listen to what happened, explain how the coverage rules here actually apply to your situation, and set out the likely next steps. Many people assume their case is too small, or that because your own insurer pays first in this state there is nothing further to recover, and that assumption is often wrong. If we take the case, we handle the insurers, the investigation and the paperwork from there. If we do not, you will still leave knowing where you stand. The review is free, your information stays private, and there is no obligation either way.

A car crash disrupts every part of life at once: your health, your income, your transportation, your peace of mind. Legal help should reduce that load rather than add to it, which is why we deal with the insurers and the details and keep you informed in plain language. We have helped people across Boston and Suffolk County get from the chaos of the first week to a fair recovery, and we are ready to do the same for you.

Fault here is measured, not assumed. Someone more than half responsible recovers nothing, and any share of fault reduces what they receive, which is exactly why insurers work so hard to move responsibility onto the injured driver, and why an early call with an adjuster matters more than it appears to at the time. Most claims must be filed within three years, some carry far shorter notice, and the evidence usually disappears long before any of those dates arrive.

City driving produces its own crash patterns: sudden stops in heavy traffic, tight merges, rotaries that visitors read wrongly, and narrow one-way streets shared with people on foot and on bikes. Those conditions shape how a collision happens and how fault gets argued, and knowing them closely is often what lets an investigation show exactly how it unfolded.

One thing to weigh: this cuts roughly 400 words. If the page has a word floor to hold, the space is better spent on car-specific material than on restoring boilerplate that 34 other pages already carry.

What a Crash Claim can Cover.

A serious crash can leave you with costs far beyond the first repair bill. A claim can cover past and future medical care, lost wages and lost earning capacity, pain and suffering, and the lasting effects of a serious injury. A full claim accounts for all of it, not just the bills that have already arrived. The losses that last longest are often the pain and the lost time a serious crash leaves behind, which a careful claim documents alongside the medical records so the recovery reflects the real toll rather than the insurer’s first number, and where an injury proves permanent, that toll can stretch across a lifetime of care and lost earning power.

Common Questions After a Boston Car Crash

Do I have a claim after a car accident?

If another driver’s negligence caused the crash and you were hurt, you likely have a claim. Massachusetts first routes medical bills and some lost wages through your own PIP coverage, but when injuries are serious you can also pursue the at-fault driver for the full range of your losses.

Yes, in many cases. No-fault PIP handles smaller claims, but once your injury crosses the state’s threshold, by requiring substantial medical expense or causing serious, lasting harm, you can step outside the no-fault system and bring a claim against the at-fault driver for your full damages.

You can still recover under G.L. c. 231, §85, the state’s comparative negligence rule, as long as your share of fault is not greater than the other driver’s. Your award is reduced by your percentage, so how fault is investigated and divided directly affects what you receive.

You may still recover through your own uninsured or underinsured motorist coverage, which is built into Massachusetts auto policies and can respond to a hit-and-run or an uninsured driver. Identifying every policy that might apply is one of the first things a lawyer does.

Be careful before giving a statement. The other driver’s insurer works to limit the claim, and an early recorded statement can be used against you. It is best to speak with your own lawyer before answering questions or signing anything the insurer sends you.

Under G.L. c. 260, §2A, you generally have three years from the date of the crash to file a personal injury claim. Because evidence, camera footage, and witness memories fade quickly, it is wise to begin well before that deadline rather than waiting.

It depends on the injuries and their lasting effect, the medical care required, the income lost, and how the crash changed your life, not on any formula. A serious injury that keeps you out of work or leaves lasting limits can make a claim worth far more than the bills alone.

It happens more than people expect, even with PIP or uninsured motorist claims on your own policy. Your insurer still owes you fair dealing, and a lawyer can push back when a PIP payment is delayed, cut off, or underpaid, so your own coverage actually does what you paid for.

For a minor bump, maybe not. But when injuries are serious, fault is disputed, or an insurer is resisting, a lawyer usually changes the outcome, handling the investigation, the medical documentation, and the negotiation so the claim reflects the full harm rather than the insurer’s first number.

If a crash proved fatal, close family members may bring a wrongful death claim under Massachusetts law for the losses they suffer, including lost support and companionship. Such a claim has its own deadline, and pursuing it can bring both accountability and some measure of stability.

Nothing up front. These cases are handled on a contingency fee, so you pay no attorney’s fee unless there is a recovery, and the first case review is free. That lets an injured person take on an insurer without worrying about hourly bills.

Call 911 and get medical care promptly, even if you feel able, because injuries can surface later. Photograph the scene, the vehicles, and any damage, exchange information, and get the names of witnesses. Then report the crash and speak with a lawyer before giving a statement to any insurer.
