It can be relevant. The Hingham Traffic Committee formally identified the Route 3A Rotary as the most dangerous intersection in town and presented that finding to MassDOT. The rotary’s documented single-lane design and driver confusion history is part of a public record. In a personal injury claim, the established history of an intersection can support an argument about what a driver should have reasonably anticipated in that location. The existence of a MassDOT redesign project for the rotary, listed on mass.gov as Project 605168, is also part of the public record. Whether and how that history applies to your specific claim depends on the facts of the crash and who was at fault.

Massachusetts is a no-fault state. Under MGL Chapter 90, Section 34M, your own Personal Injury Protection insurance covers initial medical expenses and a portion of lost wages after any car accident regardless of fault. PIP is the first step in the process for most car accident claims in Hingham. However, PIP does not cover pain and suffering and its limits may not be sufficient for serious injuries. Under MGL Chapter 231, Section 6D, once your reasonable and necessary medical expenses cross the statutory threshold, or if your injuries involve a fracture, permanent disfigurement, loss of a body part, or qualifying loss of sight or hearing, you may have grounds to pursue a pain and suffering claim directly against the at-fault driver’s insurer. High-speed crashes frequently cause injuries whose full extent does not appear until hours or days later. Call 911 and let the State Police document the crash — Route 3 in Hingham is a state highway and State Police typically respond to crashes on it. Photograph everything you can at the scene: vehicle positions, road conditions, signage, skid marks. Get the other driver’s registration, insurance information, and license. Do not give a recorded statement to any insurance company before speaking with a lawyer. Massachusetts premises liability law places a duty on property owners and occupiers to maintain reasonably safe conditions for lawful visitors. For wrongful death claims, the three-year period runs from the date of death under MGL Chapter 229, Section 2. For claims against a government entity — including the Town of Hingham, a school district vehicle, or a state highway department vehicle — MGL Chapter 258, Section 4 requires a formal written presentment within two years after the date upon which the cause of action arose, which is a separate and shorter deadline from the three-year suit deadline. The practical deadline for preserving the evidence a claim depends on is much shorter than three years. Traffic camera footage from Route 3A, the rotary area, and Derby Street can be overwritten within days. Contacting a lawyer promptly protects that evidence.
