A truck through the wall

A pickup truck crashed through the wall of a Fall River home on Saturday, October 24, injuring three people, according to Fall River Emergency Medical Services, as reported by Boston.com.

A police lieutenant who was nearby reached the scene within seconds and gave immediate aid to a person trapped underneath the truck, EMS said. Responders also found a person trapped inside the truck.

Firefighters freed the person under the truck after 30 to 40 minutes. Live wires sparking from the house and the truck slowed the rescue until National Grid cut power to the building, EMS said.

One person was taken to the trauma center at Rhode Island Hospital, and two others to local hospitals. Police later said the person who was hurt in the home had non-life-threatening injuries, NBC 10 WJAR reported.

The crash caused extensive structural damage, and everyone living in the building had to leave, Fall River firefighters said.

Charges against the driver

Fall River police charged the driver with assault with a dangerous weapon, leaving the scene of personal injury, negligent operation of a motor vehicle and a marked lanes violation, NBC 10 WJAR reported on October 27. Police have not said what caused the crash.

The charges are allegations, and the driver is presumed innocent unless proven guilty. In line with our editorial standards, Larson Law is not naming the driver.

Legal context from Larson Law

This section is the firm’s general explanation of Massachusetts law. It is not a statement about this crash or the people involved.

A criminal case and an injury claim are separate. Prosecutors decide whether to bring charges, and a conviction requires proof beyond a reasonable doubt. A person who is hurt can bring a civil claim for their injuries, which is decided on a lower standard of proof and doesn’t depend on how the criminal case ends.

Leaving the scene of a crash that injures someone is a crime in Massachusetts under G.L. c. 90, § 24. Our guide to Massachusetts hit-and-run laws explains what that law means for people who are hurt, and our page on injury claim deadlines lists the time limits for a claim.
